Rent indexation 2026 for your commercial property: how it works and what you can ask
No legal maximum for commercial property
For residential rentals, the Government sets a maximum rent increase every year. No such ceiling exists for commercial property. What happens to the rent for an office, warehouse, or shop in 2026 follows from the indexation clause in the lease agreement. In almost all ROZ contracts, this is the consumer price index (CPI) from the CBS, all households series.
The formula
New rent = current rent × (CPI of four months before the indexation date ÷ CPI of sixteen months before the indexation date).
For an indexation as of 1 January 2026, you therefore compare September 2025 with September 2024. If the indexation date falls on 1 July 2026, those would be March 2026 and March 2025.
Calculation example
The exact outcome depends on the two CBS figures for your indexation date. Calculate it yourself using the free rent indexation calculator.
Forgotten indexation?
It happens more often than you think: a landlord who fails to index for years. With ROZ contracts, this can usually still be done retrospectively within the limitation period. Correctly indexed rent is also important if you ever wish to sell: buyers calculate based on the rent that is actually being paid.
Indexation or rent increase to market rent?
Indexation follows inflation. If you want to bring the rent up to market level, that is a rent review. For shops and hospitality (Article 7:290 BW), this can be done through the courts based on comparable properties; for offices and warehouses (Article 7:230a BW), only if the contract permits it.
